​What I LOVE about this ACLU video is it strongly points out that our current approach to Criminal Justice isn't working for:
  • individuals 
  • law enforcement, or
  • families

                We've been working on the "Mental Health Crisis" problem in Criminal Justice for awhile --- we need to RAMP IT UP--- because we still have:
  • Brain Injury
  • Developmental Disability, primarily ADHD but sometimes Autism, 
  • Trauma, and
  • Cognitive Disability as a Result of Substance Use
  • Mental Illness, brain injury, developmental disability, trauma issues and substance use problems are often co-morbid.

This is a great and much-needed video AND the reality is someone could do the "Dirty Secret of Socialism" as well -- we just can't afford not to use our  Critical Thinking Skills -- most things are "Mixed Bags" -- and we are trying to make them better.

Further, ECONOMIC PROBLEMS can be complicated. 
​ Our current economic problems are more complicated than Capitalism vs. Socialism and Hanauer seems to recognize that and presents a sophisticated approach.

What is Equality?  Equality of What?

Probably from the Enlightenment to our Current Enlightenment we've thought of "Equality" as:
  • Equality under "God" 
  • Equality under the Law, and
  • ​Equality of Opportunity

In the economic order, this is mediated by an" Invisible Hand of Self Interest" and "MERITOCRACY."

There has been a lot of FEAR at all levels of the society that "Equality of Outcome" would be morally destructive.

For that matter --- it is clear that people do have DIFFERENT:
  • abilities
  • weaknesses, and
  • behaviors

What hasn't been as CLEAR --- those abilities, weaknesses and behaviors often come in packages we weren't expecting.  

Our current Enlightenment is building on the previous Enlightenment understandings of human behavior ---- "men are not angels," "power corrupts" BUT with:
  • the accent on AUTHENTICITY ---
  • problematic human behavior in hierarchical social orders --- not just the "bad people" BUT at least on some level pretty much everyone
  • a continued respect for KNOWLEDGE and SCIENCE (although not unquestioning), 
  • unmasking UNCONSCIOUS BIAS ("if you've got a brain, you've got unconscious bias")
  • a recognition this is MORE COMPLICATED than we originally thought, and
  • it takes a minute to develop PROCESSES to make INCLUSION a REALITY --- because people do have different:
    • abilities
    • weaknesses, and
    • behaviors

         This CURRENT ENLIGHTENMENT does have legal consequences -- perhaps more importantly it has  political and economic consequences.

           The more COURAGE we have to tackle our political and economic problems especially as they relate to GROSS INEQUALITY --- the less we will be relying on the Legal System to hold this Society together.
  • Economics, Racial Justice & Healthcare -- it is a dynamic mix.
  • It is made even more dynamic by the EXCEPTIONALITIES --- people who have below average or above average abilities and also issues with emotional regulation.
  • I would put Bill Clinton right in there as well as some of our other economic & political leaders.
  • Further, some of those people who find themselves in jail or prison are actually above average ---- but they have never been given the support they need.
  • Further, People with "Above-Average" Exceptionalities sometimes think -- they are "Special" -- and many of them don't really believe in "EQUALITY."

ADHD, the Microbiome & Sex-Dependent Differences
  • These are "Ideas" 
  • A lot of males with ADHD symptoms are pretty damn athletic -- not all males
  • A lot of females with ADHD are struggling with their weight -- not all females with "ADHD symptoms"
  • Further, I would submit there are probably evolutionary reasons for that.
  • MIA (Maternal Immune Activation) can also affect the Endrocrine System
  • This is really a clue that WEIGHT is a lot more COMPLICATED than we treat it.

At least sometimes the guys look like Greek Gods and the gals (me) are just this side of a prehistoric Fertility Goddess (although that Fertility is gone now in my case -- TMI) --

Further, the challenge in the 20th Century of ADHD women trying to control their weight and manage their emotions with SMOKING --- I would submit kick started an ADHD epidemic in this country.

Additionally, some ADHD women may have illegal substance problems.

BUT even if they don't -- some ADHD women like myself are relying on CAFFEINE and SUGAR to FUNCTION-- not just because we like the taste.

Further, autoimmune Thyroid problems are a common co-condition for ADHD women and I think some of those Thyroid problems are there long before we can officially pick them up.

A healthy diet can help, BUT:
  • the pull to a High Fat/ High Sugar Diet is more complicated than we think.
  • a better plant-based diet likely will "HELP" BUT it is UNLIKELY to SUFFICIENTLY address the widespread immune, cognitive and behavioral issues put into motion with MATERNAL IMMUNE ACTIVATION.
  • At least a "Healthy Diet" is INSUFFICIENT given our CURRENT understanding --- we could get a more THOROUGH and COMPREHENSIVE UNDERSTANDING 
  • BUT our society that is plagued by OBESITY--- has been LOATHE to admit  that this is more complicated than we treat it.

Val's Note:  One of things that makes metabolism complicated is --- it is connected to the GUT MICROBIOME.

The challenge for people with mental health problems and/or metabolic problems --- the GUT MICROBIOME may be improved with Fruits & Vegetables --- but it is sometimes not improved enough.

People in the Society and even Professionals sometimes aren't aware that there are MORE VARIABLES than DIET and EXERCISE.

So DIET & EXERCISE are 2 BIG VARIABLES and HIGHLY Relevant Variables to weight and also to mental health --- but there are other VARIABLES that are also HIGHLY RELEVANT.

​  What the Founding Fathers really brought to the Enlightenment of the late 18th Century was a practical alternative to MONARCHY and implementation of checks and balances divided government.

               It was far from perfect and it was an improvement.

                It would be pretty hard to say that King George was the worst Monarch or Absolute Leader ever --- but the people in the colonies were nonetheless FED UP.

                 And some people knew the problem wasn't really ultimately with King George --- it was with the system of government.

                    Right now we have a similar problem with the Two Party System or really Multiple Party Systems as well.   

                     Now occasionally somebody terrible gets into elected office --- and power does corrupt.   

                      BUT when that happens --- often we just think --- we need to get rid of this person --- we need to get a better person.

                       When does the problem with the "SYSTEM" become most OBVIOUS?    Not necessarily with the worst person --- but the person who is NOT Attila the Hun AND --- we nonetheless perceive this isn't really working.

                       Colorado is a great CASE IN POINT regarding Olmstead Compliance or lack thereof.   Colorado is NOT a poor state and compliance with federal disability civil rights law --- shouldn't be a matter of discretion.

                        But Colorado has not complied -- that non-compliance has been polite and cordial --- BUT nonetheless . . . . 

                         Olmstead Planning Groups are really Citizen Assemblies or the "Stakeholder Groups" that many states have been employing, including Colorado.

                          Disability Housing, Services and Placements are NOT really the DIVISIVE ISSUE of say --- Abortion.

                           There are COMMON UNDERSTANDINGS regarding LEAST RESTRICTIVE ENVIRONMENT as well as other principles.  

                            THE BIG STUMBLING BLOCK is FUNDING.

                             For a lot of people looking at this --- it seems we need BOTH more FEDERAL and STATE FUNDING.

                              It seems like that maybe one of the reasons the FEDS haven't CONSISTENTLY ENFORCED OLMSTEAD --- they are going to get PUSH BACK from the STATES --- cries of UNFUNDED MANDATES and requests for more money --- especially for HOUSING.   

                               There are a lot of moving parts to Olmstead Compliance -- but a large one is the NEED of more FUNDING for DISABILITY HOUSING.

This past week on LinkedIn -- NOT Facebook -- I got a connection request from a Chicago Black Adult Film maker who makes "Adult" films with Black Men and "Middle Aged White Women"

Well, you can see my dilemma -- that picture on LinkedIn is now 7 years old and I'm quickly moving from Middle Age to Old Age.

Can we do -- Black Men and Old White Women -- and, of course, I want to  be paid for my experience. 

Competitiveness & Aggression --- Non-Sequitur Sex ---- But is it?
Lateral Problem-Solving [NOT that kind of Lateral Problem Solving]
  • There are a number of Social Problems that at that their CORE are Economic Problems or seem like ECONOMIC SOLUTIONS could greatly REDUCE these problems.  Those problems include:
    • White Nationalism
    • Potentially violent groups coalescing to counter the violence of White Nationalism
    • Millennial Economic Desperation -- frustrated with BOTH Democrats and Republicans
    • Misogyny

What's the Point?  This blog is about Social Problems and how Economic Solutions might mitigate some of those social problems.

This relates to how post-secondary education reform could improve economic outcomes and ultimately play a role in mitigating some of these disturbing social problems.

This gets to an ANCIENT PHILOSOPHICAL idea about SELF KNOWLEDGE but with a HEAVY PRACTICAL TWIST.

  • Higher Ed is in many if not most cases an OVER-BLOATED DISASTER
  • We need Sophisticated & Affordable POST-Secondary & Employment Preparation that provides as much SELF-KNOWLEDGE as possible with regard to the person's:
    • ​STRENGTHS, and 
    • "Weaknesses" & NEED for Workarounds (generally Executive Functioning -- but others as well) --- the BURDEN is largely going to fall on the INDIVIDUAL to address this with others --- 
      • ​Right now -- many people with executive functioning deficits/differences --
        • don't know that they are somehow outside the mainstream,
        • professionals generally don't take it as their responsibility to know about ACCOMMODATIONS, and
        • employers certainly don't know about REASONABLE ACCOMMODATIONS for executive functioning issues.
  • A lot of this is just about being DIFFERENT -- and while that can sometimes be a BIG ECONOMIC PLUS.  Often it is not.

  • When Woody Guthrie sings: "I thought you knowed" -- who is he talking about?
    • ​a family member
    • a friend
    • himself
    • the society
    • God
    • all of the above?
  • That line:  "I thought you knowed" is pretty ACCUSATORY
  • "KNOWLEDGE" is often the BASIS OF PUNISHMENT

When I think about this song -- who 'knowed" the person is suffering -- I "knowed" --- I've "known" for almost 1/2 a century -- maybe I think of myself, my family, my clients, people I see, friends, colleagues, my extended family  --- that covers a lot.

BUT the level of that "KNOWING" has changed a lot over the last 50 years.

"Hard Travelin' " was written during the 1940s and Guthrie was not willing to RATIONALIZE the economic unfairness he had witnessed during the Dust Bowl and the Great Depression.

We've reformed Capitalism a fair amount since then but it wasn't sufficient to deal with Globalization.

Many of the biological, cognitive challenges people have are made so much worse by INSECURE:
  • Housing
  • Healthcare
  • Income and
  • Employment (employment or productive work is needed even if one does have income)

Not surprisingly -- these are also key SOCIAL DETERMINANTS of HEALTH.

I would argue that the INSECURITY is not just affecting the person at the "BOTTOM" but DRIVING plenty of BAD BEHAVIOR at the "TOP" as well.

I think we resist addressing these issues in part out of MORAL HAZARD concerns --- BUT if we DEVELOP STRENGTHS and find Workarounds for Weaknesses -- at least "LAZINESS" is probably not going to be a problem.

Further, as indicated above -- I think the H
IGH LEVEL of INSECURITY  is DRIVING BAD BEHAVIOR throughout the society.
​What's the Point?:     I'm a BIG PROPONENT of UNDERSTANDING the BIOLOGICAL Foundations of Cognitive Disability --- 

Biology and the Environment must be "INTEGRATED."

We must understand the BIOLOGY if we're ever going to have an "OBJECTIVE MEASURE" for understanding cognitive disability --- which is important since there is often a fair amount of SKEPTISM. 

BUT that BIOLOGY is interacting with the ENVIRONMENT in DYNAMIC ways.

Further, a lot times it may be EASIER to change the ENVIRONMENT to adapt to the BIOLOGY --- than the other way around.

IS IT OKAY FOR THE MENTAL HEALTH PROFESSION NOT TO BE OKAY?

 I think for most attorneys the idea is NOT to BECOME THE OUTSIDE EXPERT -- IT'S TO HIRE THE OUTSIDE EXPERT.

                 BUT what if one has serious questions about the COMPETENCE not of one PARTICULAR SUBJECT MATTER EXPERT -- BUT largely the practicing profession.

                 By and large it's not one OUTLIER failing to meet the STANDARD of CARE --- it's an ENTIRE PROFESSION that is plagued by a demonstrably low standard of care at least in large measure due to GROSSLY INADEQUATE TRANSLATIONAL MEDICINE & RESEARCH --- and I would add to that TRANSLATIONAL CRIMINAL JUSTICE.

                    We need an ON-GOING PROCESS to ADDRESS expanding research in cognitive disability and behavior and its many RAMIFICATIONS to various aspects of our society, including PUBLIC HOUSING, PUBLIC HEALTH and CRIMINAL JUSTICE.

Our Mental Health Profession is on such a CRUMBLING INTELLECTUAL FOOTING --- and that's really NOT THEIR FAULT.

BUT there are many people, families and communities who need for us to THINK ABOUT THIS TODAY.

​"The amount of medical information generated by the research community is so huge that a medical practitioner doesn’t stand a chance of ever reading even a small fraction of the available published papers in their area of specialization.

"Outcome: patient shows up with unusual symptoms, and the doctor has no idea that a month before a colleague in a faraway land has published a paper outlining the diagnosis and a novel cure."

WHAT'S OUR PLAN TO DEAL WITH MORE CRITICAL RESEARCH THAN CLINICIANS CAN PROCESS?
-- We already have 21st Century Research providing "novel perspectives" on mental illness and cognitive disability, especially as they relate to the Immune System and the Microbiome.

HOW ARE WE GOING TO GET ON TOP OF THIS?

What's the Point?  --- I think many people who are "gifted," have ADHD, Autism and/or Mental Illness --- also have Emotional and or Intellectual Overexcitabilities.

Is part of the Modern Mental Health concept of "Pro-Social Competence" -- A Respect for Authority --- are they waiting for that Authority Figure to bring them the Research.

That wouldn't be a bad system if we actually invested in it -- but we haven't --- and the Mental Health Profession's RELIANCE ON AUTHORITY has put them far behind the reported research.

Further, the FIRE HOSE of Research coming out of the MAJOR INSTITUTIONS is largely beyond unaided human capability to keep up with it -- see concerns of the Information Overload Research Group above.

​What is the point?  In many ways, the Mental Health Profession has NOT been given the Translational Research & Medicine support it needs to be a COMPETENT MEDICAL DISCIPLINE.

In lieu of that in some cases, they have set themselves up as the "Pro-Social Competency" Experts.

This isn't all bad, but it can be LUDICROUS and it can be HARMFUL and DANGEROUS as well, largely because it is unmoored from the BIOLOGICAL UNDERPINNINGS of Behavior.


AND these partial understandings along with vague personality disorders can do real harm in the Criminal Justice System and elsewhere.

THE MAGNITUDE OF THE PROBLEM -- HOW ARE WE GOING TO FUND THIS?

  • Housing is a basic HUMAN RIGHT -- bringing HOUSING to SCALE for people with Disability Long Term Care Needs --- complies with US LAW
  • Universal Basic Income:   COVID-19 has brought into HIGH RELIEF the need for UNIVERSAL BASIC INCOME.
  • Supported Employment
  • Volunteer Work

HACKING OUR BRAINS
  • Families and Extended Family Members and the Society are often put in the position of "knowing" a problem MAY BE much longer term than the person realizes.
  • ON THE FLIP SIDE OF THAT:  it's NOT CLEAR how one is going to FUND that LONG TERM SUPPORT
  • SOMETIMES/OFTEN:  The person has ABILITIES that are FAR ABOVE the AVERAGE -- but they may have DEFICITS that are DIFFERENT than the AVERAGE.  The MEAN have DEFICITS too -- BUT those generally are NOT RECOGNIZED or if they are -- they seem NORMAL.

"LAZINESS" Is  NOT the Problem We "Think" It Is
  • There's a BIG TIME Goldilocks Principle going on here -- NOT TOO HARD & NOT TOO EASY
  • That can become very complicated when the person has HIGH ABILITIES in one area of the TASK and LOW ABILITIES in another area of the task.
  • It's really BREAKING THINGS DOWN to UNDERSTAND where the Person's STRENGTHS LIE and what WORK AROUNDS/ ACCOMMODATIONS are needed for deficits.
  • WE DON'T REALIZE IT --- but we UNCONSCIOUSLY structure job descriptions to fit people in the "AVERAGE RANGE."

It is very hard to understand how we FUND HOUSING, PLACEMENTS & SERVICES --- if we can't get a lot more INNOVATIVE and CREATIVE in EMPLOYING the TALENTS people ACTUALLY have.
FUNDING for Long Term Comprehensive Cognitive Disability Care is already a CATASTROPHE in the US and in a lot of countries.

In fairness --- the CONCEPTUALIZATION of many of these issues is undergoing a RADICAL TRANSFORMATION from focusing SOLELY ON THE BRAIN --- to understanding many of these issues as COMPLEX IMMUNE DISORDERS.

Addressing Cognitive Difference in Employment--- it's ONE PIECE TOWARDS GREATER EQUALITY
  • We've really struggled as a country with the idea of "EQUALITY" when we "perceive" so much difference between people.
  • Further, the Founders imagined "God" appreciating this "equality" but they didn't seem to believe in it.
  • A lot of the people who do finally "MAKE IT" in our society do have "Cognitive Issues or Differences"
  • We want to CELEBRATE those SUCCESSES at the same time we need to realize that those people are NOT THE Übermensch  and their SUCCESS is BUILT ON the Work of Many Other People --- that are often NOT ACKNOWLEDGED.

​BIG BRAINS & DIVERSE IMMUNE SYSTEMS --- What's Different About Human Brains -- Is it how they got "PRUNED" by the IMMUNE SYSTEM?


We have some HAZY IDEAS about what "Mental Illness" is and what "Intelligence" is. 

It maybe that if we "NAIL DOWN" one of those definitions -- it is going to help us with the other.


In the last 10 or 15 years "EMOTIONAL INTELLIGENCE" has become a "THING" --- as it became more and more OBVIOUS many people with "TRADITIONAL INTELLIGENCE" didn't seem to have as much "EMOTIONAL INTELLIGENCE" as one might expect.--- WHAT'S THAT ABOUT?


In actuality we only take in --- a very tiny fraction of "REALITY."


Further, it "APPEARS" that "SOME PARASITES" help "MEDIATE" that "REALITY" even further -- by making us NOT SO SENSITIVE TO STIMULI.   

It "APPEARS" that the Human Microbiome is made up of bacteria,  fungi, protozoa and viruses that live on and in the human body AND----

Can help not only with preventing "ALLEGIES" and AUTOIMMUNE DISORDERS,  but a DIVERSE MICROBIOME can  help us regulate our "MOOD" as well--- we're literally "NOT AS SENSITIVE."


"BEING SENSITIVE" is NOT necessarily what we might imagine.  It can sometimes involve a running nose, food allergies, eczema, other autoimmune conditions --- and some EMOTIONAL OVERWHELM.



That can be coming from A LOT of PLACES. 


If you're an "ORCHID" who is HIGHLY SENSITIVE to THE ENVIRONMENT and maybe dealing with some challenging epigenetic changes to the IMMUNE SYSTEM as well as lacking some helpful PARASITES -- you maybe taking in MORE OF THE ENVIRONMENT than the next person.


​THE BUDDHIST KOAN -- IS THIS A "GOOD THING" or A "BAD THING"?
  • Well, it certainly seems COMPLICATED.
  • It 'seems" that the more information/stimuli one is taking in -- the more EMOTION is activated to "PROCESS" that.
  • At some point --- people with LAX FILTERS of various types are needing MORE TIME to PROCESS that information & stimuli --- just because they have more of it to process.
  • Do they have more of it to process because they are "INTELLIGENT"?  That seems a very loaded question -- and it "seems" that "INTELLIGENCE" isn't really what we think it is.
Professor Daniel Davis makes the point that there is from a statistical standpoint very little HUMAN DIVERSITY -- and most of the DIVERSITY that we do have does not go to appearance or skin color --- it goes to our IMMUNE SYSTEMS.

BUT those IMMUNE SYSTEMS may be affecting a lot more than our susceptibility to HIV-AIDS or CANCER.


According to 21st Century research, IMMUNE SYSTEMS  are:
  • "controlling" SOCIAL BEHAVIOR -- that's from the University of Virginia School of Medicine.
  • Down Syndrome is now conceptualized as an Immune Disorder --- University of Colorado
  • And the IMMUNE SYSTEM seems to have an ENORMOUS ROLE in Mental Illness, ADHD, Autism, the Severity of Brain Injury and Vulnerability to Substance Problems.

It also seems "LIKELY" that the Immune System & Maternal Immune Activation are involved with "Giftedness" (importantly NOT PERFECTION).  "Giftedness" is typically marked by:

  • "Over Excitabilities"
  • Above-average ability in one or more areas

  • One of the great THEMES in Western Literature is --- Things are NOT what they appear.
​
  • With regard to cognitive (invisible) disability that can certainly be the case for:
    • ​the person
    • the family
    • the professional 
    • the society
​
  • ​If you can CURE IT -- that's great -- if you can't ---and that includes pretty much everybody (including me) then --- the understanding is pretty shaky and likely WRONG in some areas. 
​
  • When I say "CURE IT"/"TREAT IT" --- I mean "CURE IT"/"TREAT IT" for THAT PERSON --- not some hazy this should work -- but you've got the PRECISION MEDICINE that "IT" does work and it works for this person.
​
  • A BIG PART of the Ethical & Moral Challenge of dealing with Cognitive Disability (Invisible Disability) in 2020 is dealing with UNCERTAINTY and the NEW KNOWLEDGE that is coming in.
 
  • We have to integrate Physical & Mental Healthcare --- that means not having LITTLE MENTAL HEALTH SILOS / GHETTOS.

  • It takes enormous TIME & ENERGY to TRANSLATE complicated new research into UNDERSTANDINGS, APPROACHS and TREATMENTS that Clinicians can actually use.​​
 
  • That means RESOURCES and MONEY and a lot of it for TRANSLATIONAL RESEARCH & MEDICINE.
 
  • We are doing all kinds of DAMAGE to Individuals, Families and the Society by our current CRIMINAL JUSTICE approach.

  • Cognitive Disability --- Brain Injury, Mental Illness, Substance Issues and Developmental Disabilities are RAMPANT in our JAILS & PRISONS
​
  • ​Olmstead Compliance, Parity, Medicaid Network Adequacy --- WHERE ARE YOU? ​​
